This document sets forth the Privacy Policy (the "Privacy Policy") of Dorel Juvenile ("we", or "us") for the mobile applications - App, websites, content and features (collectively the "Services", "mobile application") and the Connected Suite of products (the "Products"). By using or accessing the Services of the mobile applications and/or Products you signify your acknowledgment and assent to this Privacy Policy. If you have objections to the Privacy Policy, you should not access or use the Services and/or Products. This Privacy Policy does not govern privacy practices associated with other Dorel Juvenile activities or the collection of information other than through the mobile application Services and/or Products. This Privacy Policy is intended to help you understand how Dorel Juvenile and its affiliates collect, use and safeguard the personal information you provide in connection to the mobile application Services and/or Products. It does not apply to the use or disclosure of information that is collected or obtained by Dorel Juvenile through other means. 1. PERSONAL INFORMATION

We collect personal information in connection with establishing and maintaining your account for the Services and responding to support inquiries, such as your first and last name, email address, location, internet cookies, mailing address, telephone number, and other personal information. Some of the information that we ask you to provide is mandatory and some is voluntary. If you do not provide the mandatory data, you may not be able to engage in the particularly associated activity. Personal information collected in connection with the Services and/or Product will be used by Dorel Juvenile, its affiliates and third parties authorized by Dorel Juvenile to perform and provide the Services and/or support the intended functionality of the Products.

When you use the Services and/or Product, Dorel Juvenile or third parties authorized by Dorel Juvenile may also collect certain usage data and technical and routing information about your mobile device (collectively, "Usage Information"), such as browser type, operating system, device ID, CPU speed, and the Internet Protocol ("IP") address of your device. We use the Usage Information to facilitate and track your use of the Services and/or Product, to measure traffic patterns on the Services and/or Product and to otherwise administer our Services and/or Product. Without expressly informing you, we do not match such Usage Information with any of your personal information.

When you register your account, you may have opted-in to receive promotional communications. If you have opted-in, your personal information may be used by Dorel Juvenile and its affiliates to keep you informed about product upgrades, special offers, and other products and services of Dorel Juvenile, its affiliates and authorized third parties. If at any time you do not wish to receive promotional messages, you can use the opt-out method detailed in any message you receive or contact Dorel Juvenile using the contact information found under section 19.

When you submit personal information to Dorel Juvenile through the Services and/or Products, you understand and agree that this information may be transferred across international boundaries and may be stored and processed in any of the countries in which Dorel Juvenile, its affiliates and subsidiaries maintain offices, including, without limitation, the United States of America and Canada.

Dorel Juvenile may authorize third parties to collect, store or access your personal information in connection with certain aspects of the Services and/or Product, however such Providers will be bound by contract not to use your personal information for their own purposes, to sell it or to disclose it to others unless necessary to ensure proper function of the Services and/or Product. Except as described in these Terms of Use, we don't rent, sell or otherwise distribute to others any personal information collected in connection with the Services and/or Product, including to any third party for such third party's direct marketing purposes. The Services and/or Product do not collect personally identifiable information about an individual user's online activities across third party web sites (and thus do not monitor any applicable Do Not Track indicator).

NO SALE OF PERSONAL INFORMATION

As of the effective date of this Privacy Policy, We do not sell any personal information to any third party. Any change in our position on the sale of personal data will result in an update of this Privacy Policy and we will provide you with the opportunity to opt out of this.

1.1 TYPES OF PERSONAL AND SENSITIVE INFORMATION COLLECTED, PROCESSED & DISCLOSED.

The following is a list of categories of Personal Information collected and processed via your use of the mobile application ("Services") and the Products. Some of the information that we ask you to provide is mandatory and some is voluntary. If you do not provide the mandatory data, you may not be able to engage in the particularly associated activity being provided by the Services and/or Products.

2. USAGE INFORMATION

The Services and/or Product of Dorel Juvenile and its authorized third parties automatically record certain information about how a person uses the Services and/or Products ("Usage Information"). Usage Information may include information such as a user's Internet Protocol (IP) address, location, domain name, referring web page, device and browser type, operating system, device settings, the features of the Services and/or Products accessed and the time spent using those features, frequency with which the Services and/or Products are used by a user, search terms, the features and links on the Services and/or Products that a user clicked on or used, and other statistics. We use this information to administer and support the Services and/or Products and we analyze this information to improve and enhance the Services and tailor them to our users' needs and preferences. We may use third party web analytics tools to collect and analyze Usage Information. Usage Information does not, in and of itself, identify you personally, but we may link it to personal information for account holders.

a. Services and/or Product Data

We may collect and record information relating to the setup, general performance, and operation of the Services and/or Product, including Services and/or Product status, User Content that a Service and/or Product's sensors record (including audio, video, motion), and your Services and/or Products usage. We may store this data along with your personal information and other information about your use of the Services and/or Products. We use this information to allow you (and us) to monitor and operate the Services and/or Products.

b. Location Data

The Services and/or Products may collect location information based on your IP address but do not collect precise GPS information about the location of your mobile device. We may associate this data with information associated with your user account.

c. Cookies and Beacons

Usage Information may be collected via "cookies," which are small text files that are saved by your browser or device when you access the Services and/or Products. We (and our third-party providers, such as Google® Analytics) may use cookies to identify that you've logged into the Services and/or Product and to tell us how and when you interact with the Services and/or Product. We may also use cookies to monitor aggregate usage and web traffic routing for the Services and/or Products and to customize and improve the Services and/or Products. Some apps and browsers have options to stop automatic acceptance of cookies or to prompt you before accepting cookies. You can also delete any cookie on your mobile device by uninstalling the mobile application. Please note, however, that if you don't permit cookies, you may not be able to access all portions or features of the Services and/or Products. Software technology called tags or web beacons (a.k.a. pixel tags or clear gifs) may also be employed to help us better manage Services and/or Products content and communications by informing us how certain content or features are used. These beacons (or other tracking technology) may be included in or associated with e-mails or other communications that you receive from us (or our Provider). We may link data gathered by web beacons or other tracking technology to the personal information of account holders.

d. Push Notifications

You may sign up to receive "push notification" messages. To make sure messages reach the correct devices, our third-party service provider relies on a device token unique to your mobile device. A device token is a unique identifier issued to the app by the operating system of your mobile device. While we may be able to access a list of the tokens, neither the mobile application nor the tokens will reveal your identity, your unique device ID, or your contact information to us. The third-party service provider may collect the following: the time of an event, how a User came to our site, what search engine and search keywords users may have used to get to our site, information about the device our user is on such as their Operating System, and browser, as well as the city, region and country location of users. This location information enables Dorel Juvenile to send public health push notification messages that are relevant to certain geographic locations. If, at any time, you wish to stop receiving push notifications, simply adjust your phone settings or remove the App.

Dorel Juvenile and its affiliates may use aggregated or non-identifying data and Usage Information from the Services for analysis, technical, marketing or other business purposes and provide such aggregate or deidentified data to third parties for such purposes.

3. MINORS

No information should be submitted to the Services or Products by individuals under 18 years of age, and users of the Services or Products under 18 years old are not permitted to provide Registration Information or to sign up for contests, newsletters, clubs or activities. By using the Services, you represent that you are at least 18 years of age or that you are the parent or guardian of such minor and consent to such minor(s) use of the Services and/or Products. We do not knowingly collect or use any personal data from minors except in conjunction with the Products and Services which depend on that data to function, and where the collection and use of that data is apparent to the user of the Products and Services e.g. in our Connected suite of products. If we learn that we have engaged with a minor as a consumer and collected personal information outside of an approved context, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from a minor under the age 18 years old, please contact us via the options listed in the CONTACT INFORMATION section of this privacy policy.

4. LINKED SITES

The Services and/or Products contains links to other sites at which personal information is collected. In such instances, unless expressly provided to the contrary, the collection and use of your personal information will not be governed by this Privacy Policy but by the privacy policy applicable to that site. That privacy policy should identify the entity that is collecting your personal information.

Dorel Juvenile has established relationships with various service providers whose services may be available to you from this Services and/or Product or from websites that are linked to this Services and/or Product. Typically, these providers offer services that Dorel Juvenile customers might find useful, such as those that can be used in conjunction with Dorel Juvenile services and products. In order to use those services, you may be required to provide personal information to the providers. Unless expressly stated to the contrary, personal information that you provide while you are visiting a provider's website will not be subject to this Privacy Policy but to the privacy policy posted on such site. However, personal information that you provide while using the Services and/or Products in conjunction with a provider's service will be subject to this Privacy Policy. You should be aware that our agreements with these service providers often provide that they will share with Dorel Juvenile personal information collected from you. In such instances, Dorel Juvenile may use this information in a manner consistent with this Privacy Policy.

5. OTHER DISCLOSURES

We reserve the right to disclose without notice to you any information in our possession if we believe we are required to do so by law, to protect or defend Dorel Juvenile rights or property, or to respond to an emergency. Specific portions of the Services and/or Product may include additional or different provisions relating to collection and disclosure of personal information. In the event of a conflict between such provisions and this Privacy Policy, such specific terms shall control.

Financial Incentives – subscriptions to marking initiatives may lead to promotional discounts.

"Financial incentive" means a program, benefit, or other offering, including payments to consumers as compensation, for the disclosure, deletion, sharing, or sale of personal information.

The law permits financial incentives or a price or service difference if it is reasonably related to the value of the consumer's data. 6. SECURITY

While we use commercially reasonable efforts to safeguard the confidentiality of your personal information, we cannot guarantee that your data will always remain secure due to transmission errors, outside events, third party cyber-incidents or other causes, and we will not be liable, therefore.

7. DATA ACCESS, RETENTION AND DELETION

You may review, update, correct or delete certain personal information or User Content associated with your account by logging into your account. If you wish to update or delete other personal information, you can contact us using the contact points specified below. We will take steps to modify or delete your personal information as soon as is practical, but some information may remain in archived/backup copies for our records or as otherwise required by law. We will keep personal information about you for as long we have purpose to do so. Upon termination of your account, we will retain all personal information and User Content only for as long as necessary to fulfill our obligations in connection with the Services and for any additional period of time necessary to comply with applicable law, including any applicable statute of limitations.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

a) Right to withdraw consent if we have collected and processed your personal information with your consent, to withdraw your consent at any time, which may be express and/or implied consent depending on the applicable law. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

b) Right to designate an authorized agent you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf.

9. VERIFICATION PROCESS

In order to ensure the protection and safeguard of your personal data / information, upon receiving your request, we will need to confirm your identity to determine you are the same person about whom we have the information in our system.

These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification.

However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request. In the unlikely event that we are not able to comply with your request, we will inform you of our decision and reasoning behind it.

You may contact the relevant authorities, namely the local Attorney General in US or the Office of the Privacy Commissioner of Canada’s Information Center, to submit a complaint.

If you have an unresolved privacy or personal data collection, use, or disclosure concern that we have not addressed satisfactorily, please be aware you can address your concern to the above mentioned privacy supervisory authorities.

10. DATA TRANSFER

When you submit personal information to us through the Services and/or Product, you understand and agree that this information may be transferred across national boundaries and may be stored and processed in any of the countries in which we and our affiliates and subsidiaries maintain offices, including, without limitation, the United States of America and Canada. You also acknowledge that in certain countries or with respect to certain activities, authorized vendors of Dorel Juvenile (namely technical and troubleshooting service providers, cloud service providers, security support services) may undertake the collection, transferring, storage, and processing of your information for us. Such vendors are bound by contract not to use your personal information for their own purposes or provide it to any third parties. One instance where this could occur is in conjunction with framed pages in which the URL for the pages is not visible and the pages are being hosted by a vendor of Dorel Juvenile.

If you are a not resident in the European Economic Area (EEA) or United Kingdom (UK), then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this privacy notice and applicable law.

We have implemented measures to protect your personal information between our group companies and between us and our third-party service providers. These clauses require all recipients to protect all personal information that they process in accordance with data protection laws and regulations. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.

13. FORCE MAJEURE

DOREL JUVENILE and its Providers shall not be responsible for delays or failures in performance resulting from acts or circumstances beyond their control, including without limitation acts of God, strikes or other labor disputes, riots, acts of war, malfunction of portions of the Internet or another third party network, governmental regulations promulgated after the effective date of these Terms of Use, communication line, power or equipment failures, fires or other disasters, and acts of third parties, including hackers (each a "Force Majeure Event").

14. DISPUTE RESOLUTION

PLEASE READ THE FOLLOWING SECTION CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE DISPUTES AND IT LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF. To the fullest extent permitted by law, these Terms of Use, and any claim, dispute, action, cause of action, issue, or request for relief relating to these Terms or Use, the Services or Product, will be governed by the laws of Indiana, U.S.A., without giving effect to any conflicts of laws principles that require the application of the laws of a different jurisdiction. To the fullest extent permitted by law, any dispute or claim relating to this Privacy Policy, the Services and/or Product will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association ("AAA"), rather than in court (except that you may assert claims in small claims court if your claims qualify, and you or we may seek injunctive or equitable relief in court to stop infringement or other misuse of intellectual property rights). The Federal Arbitration Act and federal arbitration law apply to the enforcement of this agreement to arbitrate. TO THE FULLEST EXTENT PERMITTED BY LAW WE EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED OR REPRESENTATIVE ACTION. This arbitration provision does not preclude you from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf. If for any reason a claim proceeds in court (other than small claims court) rather than in arbitration you and Dorel Juvenile each waive any right to a jury trial and irrevocably consent to the exclusive jurisdiction of the courts located in Columbus, Indiana in connection with any such action. You and Dorel Juvenile waive any objection based on lack of personal jurisdiction, place of residence, improper venue, or forum non convenience in any such action.

15. EXPORT COMPLIANCE

Although the Services and/or Product may be accessible worldwide, our Services and/or Product are not designed for use in all countries, and some or all of the features of the Services and/or Products may not work or be appropriate for use in a particular country. The Services and/or Products and related technology are subject to U.S. export control laws and may be subject to export or import regulations in other countries. You represent and warrant that you are not named on any U.S. government list of restricted or prohibited persons or entities or located in a country that is subject to U.S. government embargo or restrictions. You agree to comply with the export laws and regulations of the United States and other applicable jurisdictions in providing and using the Services and/or Product. You will not permit anyone to access or use the Services and/or Product in violation of any U.S. export embargo, prohibition or restriction.

16. ELECTRONIC COMMUNICATIONS

When you use the Services and/or Products, send us e-mails, or send text messages, you are communicating with us electronically, and you consent to receive communications from us electronically. We may communicate with you by e-mail, text message, or by transmitting notices via the mobile application. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

17. CONTINUITY

Please note that if Dorel Juvenile sells assets (or the assets of a division or subsidiary) to another entity, or Dorel Juvenile (or a division or subsidiary) is acquired by, or merged with, another entity, Dorel Juvenile may provide to such entity customer and personal information that is related to that part of our business that was sold to or merged with the other entity without your consent.

18. GENERAL

These Terms of Use, including any applicable Service Terms and other materials incorporated herein, represent the entire agreement and understanding relating to the use of the Services as well as Products and prevail over any prior or contemporaneous, conflicting or additional communications. The English version of this Privacy Policy shall govern over any translation. You acknowledge and agree that each of Dorel Juvenile’s Providers, as well as Apple, Google and other applicable OS providers, shall be considered a third party beneficiary of these Terms of Use and shall have the right to enforce this Privacy Policy directly against you in connection with any dispute or breach.

Any unauthorized access, modification or change of any information, or any interference with the availability of or access to the Services as well as Products is strictly prohibited. Dorel Juvenile reserves all legal rights and remedies available to it and this Privacy Policy shall in no way be deemed a limitation or waiver of any other rights Dorel Juvenile may have.

Our failure to assert a right or insist upon compliance with any term or condition shall not constitute a waiver of that right or excuse any subsequent noncompliance. If any provision of this Privacy Policy is deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the remaining terms and shall not affect the validity and enforceability of any remaining provisions. The parties agree that any invalid provision shall be deemed to be restated so as to be enforceable to the maximum extent permissible under law consistent with the original intent and economic terms of the invalid provision.
